Cab Condition Claims (code CC 32.5 miles)

In all cases do not refuse to take units with these conditions!  You do not own this railroad not one nut or bolt!  Report these conditions promptly to the proper authority and be governed by their decision. The following is a process to penalize the carrier and pay one for non compliance of agreement and/or law.  Award # 458 and ID run thru agreements are what these claims come from.

Non-working water coolers:  In the case of B/O water coolers a minimum of 4 things must happen for a claim to be valid.

1.       The unit in question must have been reported for the B/O cooler PRIOR to leaving a location that repairs the condition. i.e. Lincoln, Alliance, or Guernsey.

2.       The report must be made to Ft. Worth Mechanical via the VTR or other means available.  In Alliance or Guernsey report to the Yardmaster as well.

3.       The condition must remain not repaired and used as the lead.

4.       The proper BNSF form (Chartreuse Green Cab Condition tag) must be filled out correctly. Retain a copy in the event the code CC is declined.

 

Non-working or Unsanitary Toilet:  In the case of B/O toilets the condition is non-complying and can not be used as a lead per FRA when the next 203 inspection is due. Non-working means does not flush.  Unsanitary means; wicked bad odor, over filled or chunks that do not clear the bowl when flushed. 

1.       The condition must be reported to the Ft. Worth Mechanical and when in Alliance or Guernsey to the Yardmaster.

2.       The unit must be repaired or switched out in Alliance or Guernsey prior to departure.

3.       When the condition is found were repairs can not be made or the unit can not be switched out a CC claim should be made.  Again this is a non-complying condition when 203 inspections are due.

4.       In making the claim state in detail the nastiness, and the time spent with it. 

 

Non-working Heater:  In the case of B/O Heaters the condition is non-complying when the temperature in the cab directly above the engineers seat can not be maintained to at least 50 degrees Fahrenheit.

1.       The condition must be reported to the Ft. Worth Mechanical and when in Alliance or Guernsey to the Yardmaster.

2.       The unit must be repaired or switched out in Alliance or Guernsey prior to departure.

3.       When the condition is found were repairs can not be made or the unit can not be switched out a CC claim should be made.  Again this is a non-complying condition when 203 inspections are due.

4.       In making the claim state in detail how the lack of any working heaters sidewall or other didn’t keep the cab warm and the outside temp is also important as well as time one spent in this condition.

 

Non-working Weather stripping:  In the case of B/O weather stripping a minimum of 4 things must happen for the claim to be valid

1.       The unit in question must have been reported for the B/O weather stripping PRIOR to leaving a location that repairs the condition.

2.       The report must be made to Ft. Worth Mechanical via the VTR or what ever means available.  When in Alliance report the condition to the Yardmaster as well. 

3.       The condition must remain not repaired and used as the lead.

4.       The proper BNSF form (Chartreuse Green Cab Condition tag) must be filled out correctly. Retain a copy in the event the code CC is declined.

5.       In making the claim state in detail how the lack of weather stripping caused undue duress i.e. cold, dirt, smoke coming in from outside etc.
